Congress: It didn’t take long to run into an “uh-oh” moment when reading the House’s “health care for all Americans” bill.
Right there on Page 16 is a provision making individual private medical insurance illegal.
When we first saw the paragraph Tuesday, just after the 1,018-page document was released, we thought we surely must be misreading it. So we sought help from the House Ways and Means Committee.
It turns out we were right: The provision would indeed outlaw individual private coverage. Under the Orwellian header of “Protecting The Choice To Keep Current Coverage,” the “Limitation On New Enrollment” section of the bill clearly states:
“Except as provided in this paragraph, the individual health insurance issuer offering such coverage does not enroll any individual in such coverage if the first effective date of coverage is on or after the first day” of the year the legislation becomes law.
So we can all keep our coverage, just as promised — with, of course, exceptions: Those who currently have private individual coverage won’t be able to change it. Nor will those who leave a company to work for themselves be free to buy individual plans from private carriers.
From the beginning, opponents of the public option plan have warned that if the government gets into the business of offering subsidized health insurance coverage, the private insurance market will wither. Drawn by a public option that will be 30% to 40% cheaper than their current premiums because taxpayers will be funding it, employers will gladly scrap their private plans and go with Washington’s coverage.
The nonpartisan Lewin Group estimated in April that 120 million or more Americans could lose their group coverage at work and end up in such a program. That would leave private carriers with 50 million or fewer customers. This could cause the market to, as Lewin Vice President John Sheils put it, “fizzle out altogether.”
What wasn’t known until now is that the bill itself will kill the market for private individual coverage by not letting any new policies be written after the public option becomes law.
The legislation is also likely to finish off health savings accounts, a goal that Democrats have had for years. They want to crush that alternative because nothing gives individuals more control over their medical care, and the government less, than HSAs.
With HSAs out of the way, a key obstacle to the left’s expansion of the welfare state will be removed.
The public option won’t be an option for many, but rather a mandate for buying government care. A free people should be outraged at this advance of soft tyranny.
Washington does not have the constitutional or moral authority to outlaw private markets in which parties voluntarily participate. It shouldn’t be killing business opportunities, or limiting choices, or legislating major changes in Americans’ lives.
It took just 16 pages of reading to find this naked attempt by the political powers to increase their reach. It’s scary to think how many more breaches of liberty we’ll come across in the final 1,002.

Everyone needs to send this to everyone they know. Where can we get a copy of the bill?
What kind of country are we becoming? Well acording to Obama we are nolonger a Christian country. I never believed that obama was anything but a non christian and he sure is proving a lot of us to be correct. If this bill passes he needs to be the first NOt to receive any health care treatment for himself and anyone in his family not worthy. I work with the geratrics and many of them who are 80 and 90 yrs old have received surgery, rehab and have done very well. So, Who is he to determine who should or shouldnt receive health care. Shame on you
Unfortunately, thanks to Senator Kennedy, a provision is provided in the bill for senators to not lose THEIR health care while all of us lose ours.
This is outrageous and cannot be condoned. People must be given the freedom to choose. This plan will only allow the deficit in the USA to increase and generations to come will be charged to pay this bill. It is not fair.
As time goes on, it is my belief that we will be able to choose less and less as our liberties and our constitution are extricated from our country’s mores.
And where does this country go to get its money? CHINA…………therefore, when this health care bill rears its ugly head, our country will go belly-up, then crawl on our knees to China for more money………..between Obama and China, who has to worry about the bomb?
I believe that China, whenever it chooses, can call its debt to our detriment. Thanks for writing.
Under the House bill, companies that offer insurance to individuals will do it through an exchange, where the government sets minimum standards for coverage. The new regulations require insurance companies to accept people even if they have previously existing conditions and to provide a minimum level of benefits, among other things.
This means that insurance companies will not longer be able to participate in predatory tactics which in turn screw over the common American so they can stuff their pockets with bonuses based off of denied coverage.
This is NOT a secret and it is NOT dirty. It is genius and about time.
I am continually amazed at what people will believe. Insurance companies, in order to exist, must make a profit. Yes, they are private sector businesses. Once Obama Care is out there not needing to make a profit because they are using our tax dollars, they will push out the private sector and you will have only single payer health care. If you like that, go live in Britain or Canada or Sweden for awhile and see how well you like it…especially if you are over 65. Then dont let them exist. Do you know how much money insurance companies make? I have done loads of research. How can you keep standing up for insurance companies? Obama care will marginalize their profits, not kill them. Yes, some will go out of business and they should.
I lived in the UK for two years and I loved the healthcare!
I graduated from a top tier law school. The last thing I need is someone who has poor sentence structure and uses unnecessary commas to call me naive when the only point I made was that it doesn’t destroy healthcare the way we know it.
Also, one of reasons I went to law school was insurance schemes. This came to head after reading the Rainmaker. Give it a read.
Now that we are on the subject, I think this plan is genius because it stops all the rationing that is going on in the present system. Yea, preexisting conditions. Be part of the solution, not the problem.
You are throwing the baby out with the bathwater, Dan. We can reform health care without destroying choice which is what a single-payer plan would do. Have you read the bill? I think not. If you had, you would not think it was genius. You may have “loved” your health care because you weren’t ill or old.
Page 22 mandates audits of all employers that self-insure. Page 29. It admits on page 29 that your health care will be rationed.
Page 30: A government will decide what treatments and benefits you get, and unlike an insurer, there is… Well, there’s an appeals process that you don’t even want to mess with that. Page 58: Every person will be issued a national ID health card.
Page 59: The federal government will have direct real-time access to all individual bank accounts for electronic funds transfer.
Page 239: The bill will reduce physician services for Medicaid, meaning there will be Medicaid cuts. The president is out there saying that there won’t be.
Page 427: Government mandates program that orders end-of-life treatment. Government dictates how your life ends. The Washington Post read the section, Section 1233 and came to the same disturbing conclusion.
Page 429: Advanced care planning consult will be used to dictate treatment as patients’ health deteriorates. This can include an order for end-of-life plans. The order will be from the government.
And speaking of writing skills, you could learn a few things about punctuation and paragraphs…maybe they don’t teach that in law school these days. I know that the trial lawyers are Obama puppets. Obviously you are just about as narcissistic as your almighty leader is. Your degree does not impress me at all– B.O. is from Harvard and he is as clueless as you are.
The IBD is lying about page 16 and so are you.
It does not say that insurers cannot write new policy.
It says they cannot write new policy on the old standards. It says that any new policies they write must conform to the new standards once those new standards are in effect.
It also says that if you have an existing policy that does not meet the new standards you can keep it if you choose, as long as it was in effect before the new law takes effect.
Read the bill. Or at least read page 16 before you skwak about it.
Your ignorance is dangerous.
Somehow, I believe the IBD rather than you or any of the CNN commentators who have an agenda to support their leader. What do you think those new standards might be? How long before the insurance companies can no longer exist due to the non-for-profit situation of the government program? What is dangerous is that clueless people like you are still out there after all this time when you could have found out the truth but chose instead to just believe what your fraudulent government tells you.
